This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from https://8paint.art (the “Site”).

Who we are and what we do

This Privacy Policy covers 8paint, llc. (collectively, “8paint,” “we” “us” or “our”). We provide online courses, workshops and class related services through our owned-and-operated websites, including 8paint.art, 8paint.net and artofgabriel.com

Changes and Acceptance

By registering, enrolling, or using our services, you accept this Privacy Policy, which is part of our Terms of Service. We may modify this Privacy Policy from time to time. We will post any modified version of our Privacy Policy at https://8paint.art/8paint-privacy-policy/

If we change the Privacy Policy in a way that materially lessens our commitments to you, we will provide notice to registered users by email or other methods.

     

2. INFORMATION WE COLLECT ABOUT YOU


Account Information

We collect information from you when you place an order.

When ordering or registering on our site, as appropriate, you may be asked to enter your: name, e-mail address, mailing address, phone number, credit card information or Billing Address.

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information.”

We collect Device Information using the following technologies:

– “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information including email address, and phone number. We refer to this information as “Order Information.”

We collect information about you during the course purchase process (PayPal, Partial.ly and/or Stripe), as well as information relating to your course progression and assignments.

Financial Information

When making a purchase, you may need to provide a valid payment method (e.g., credit card or PayPal account). Your payment information will be collected and processed by our authorized payment vendors. We do not directly collect or store credit or debit card numbers ourselves in the ordinary course of processing transactions. If we allow purchase through a third-party platform (i.e. Partial.ly), the payment method stored with the third-party platform will be charged.

Content

Accountholders may upload and create content such as profile image, text, photographs, and artwork. Your profile may display information about you and your activities. This information may be accessed by others. Your profile may be viewed and otherwise accessed by others, and associated metadata (e.g., titles, descriptions, tags, etc.) are viewable by others. Your interactions with other users (e.g., comments, “likes,” private messages) may be seen by others. You may choose to limit the availability of your profile.

Other Information You May Submit

You may submit data to us for limited purposes such as requesting customer support; answering a questionnaire; participating in a study or survey or signing up to receive communications from us.

Automatically-Collected Information

We automatically collect certain types of data when you use our services, regardless of whether you have an account. This data includes your IP address, technical information about your device (e.g., browser type, operating system, basic device information), the web page you visited or search query you entered before reaching us, and your activities. We may track your activities using cookies and similar technologies. By using our services, you agree to our use of these methods as set forth in our Cookie Policy.

Information Collected by Third Parties

Some third parties may collect data about you when you use our services. This may include data you submit (such as payment information) or automatically-collected information (in the case of third-party analytics providers).

3. HOW WE USE YOUR INFORMATION


Any of the information we collect from you may be used in one of the following ways:

  • To process transactions: Your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without your consent, other than for the express purpose of delivering the purchased product or service requested.
  • Identification and authentication: We use your information to verify you when you access your account.
  • Operating our services: We use your information to provide our services, process and fulfill orders, provide customer support, and to otherwise comply with our contractual obligations to you. We (and/or our third-party vendors) use your financial information to process purchases made by you and to pay you amounts you have earned if you are an affiliate.
  • Communicating with you: We use your information when we communicate with you (e.g., when we respond to a customer support or other inquiries).
  • Improving our services: We use your data to understand how our courses and workshops are being used and how we can improve them. In general, we analyze aggregated data, rather than specific user data. We may, however, need to analyze a specific case to address a specific problem (e.g., a bug that affects only a few users).
  • Exercising our rights: Where reasonably necessary, we use your information to exercise our legal rights and prevent abuse of our service. For example, we may use your information to detect and prevent fraud, spam, or content that violates our Terms of Service.
  • Legal compliance: We use your information where we are legally required to do so. For example, we may need to gather your data to respond to a subpoena or court order.
  • To send periodic emails: The email address you provide for order processing, may be used to send you information and updates pertaining to your order, in addition to receiving occasional company news, updates, related product or service information, etc.
  • Protecting your information: We implement a variety of security measures to maintain the safety of your personal information when you place an order. We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our Payment gateway providers database only to be accessible by those authorized with special access rights to such systems, and are required to keep the information confidential. After a transaction, your private information (credit cards, social security numbers, financials, etc.) will not be stored on our servers. Where appropriate, we may anonymize, backup, and delete certain data.
  • Who on our team has access?
    Members of our team have access to the information you provide us. For example, both Administrators and Group Leaders can access:
    • –Order information such as your enrolled courses, course progress and username / email address.
    • Any additional information added in your 8paint.art User Profile can also be visible to the administrator(s).

Note: If at any time you would like to unsubscribe from receiving future emails please respond by sending an email with “Remove from mailing list” as the subject.

                 

4. INFORMATION DISCLOSURE


We do not sell, trade, or otherwise transfer to outside parties your personally identifiable information. This does not include trusted third parties who assist us in operating our website, conducting our business, or servicing you, so long as those parties agree to keep this information confidential. We may also release your information when we believe release is appropriate to comply with the law, enforce our site policies, or protect ours or others rights, property, or safety. However, non-personally identifiable visitor information may be provided to other parties for marketing, advertising, or other uses. As an example, we may use session and persistent “cookies”, session logs, pixel tags, third-party click tracking analytics tools (such as Google Analytics,) third-party retargeting networks that may display our advertisements to you on other sites to collect personally identifiable or other aggregated information about our site visitors.

We share information with third parties who help us provide our orders and store services to you; for example Mailchimp and PayPal to provide communication between you and the site.

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

Visitor comments may be checked through an automated spam detection service.

Affiliates and advisors: We may share your data with our auditors and advisors for planning, financial reporting, accounting, auditing, tax filings, and legal compliance. We may share your data with our affiliates to the extent necessary to provide you with the services ordered.

Authorized vendors: We may share your data with third-party vendors that help us operate our services, process orders, and comply with your instructions and our contractual obligations. This includes payment processors, content delivery networks (CDNs), cloud-based hosting services, monitoring services, email service providers, quality assurance and testing vendors, fraud and abuse prevention vendors, customer relations management (CRM) vendors, and shipment vendors

Certain legal situations: We may share your data where we believe disclosure is necessary to comply with a legal obligation.

                     

5. DATA RENTENTION


When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information. If you are subscribed to one of our mailing lists, you can change your information and the lists you have subscribed to at any time by clicking on “update your preferences” at the bottom of any of our email that you receive. Please know that it may take up to 30-45 days for you to be removed from all of our lists.

If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.

If we receive legal process pertaining to your account, we will retain your data for as long as we in good faith believe is necessary to comply with the legal process. Similarly, if we believe that your account has been involved in wrongdoing, we may preserve your data to defend or assert our rights.

                           

6. COMMENTS


When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

                             

7. COMMUNICATIONS FROM US


Emails

When you create an account, you will receive emails from us. This includes account and purchase transactional emails. If you’re enrolled into one or more of our courses or workshops, you will also receive email notifications of class and online schedules.
